保護版權不是尊重版權(即鼓勵創作和為作者提供合理回報)。版權沒有和不應為投資者提供謀取暴利的方法。

Why HK gov't choose to take the lead?

Simply put, HK is not in a position to take the lead in drafting these IP laws. The HK gov't should explain/prove beyond doubt why the HK gov't have to take the lead. (But I don't think they can.) Why not USA? Why not France, etc.?
Frankly, I think the real motive is that the big sharks find the HK gov't very easy to exploit. And this HK gov't seems willing to be exploited. Otherwise, it is hard to explain why HK gov't choose to take the lead.
"Take the lead" is the key of the issue.

早前工作關係,與負責版權法的知識產權署人員接觸,問及他們有關現時諮詢文件,及其他版權問題,大致回覆如下:
1.有關再創作問題,如上述胡戈的饅頭創作,他們十分鼓勵,並只他們先付了創材素材(即上述的無極)的版權費,就可以再創作,而創作出來的作品也是版權作品,所以可以收取版權費呢.我再追問, 那麼資金不多的小製作,無力支付版權費, 那怎辦,官員的回應是,無可否認資本小的製作單位較輸蝕,但畢竟香港是市場運作嘛.聽罷眼突兼幾近噴飯.

2.關於本港的授權機構(如ifpi,cash)壟斷,他說如果有有不滿,自然會不參加,或者有新的授權機構出現,這是市場定律, 不用政府干預

3.fair use問題,他說現在的2006版權修訂條例已涵蓋.

枝節的細項還有許多, 但卻自誇版權持有人其實好多建議, 包括延長版權期限等, 而政府都不是所有都跟隨,所以已經好顧及用者利益.

對此, 不知各位關心知識版權問題的人,又是否如是觀
