外藉家務工的工資，工時及工作狀況展示出現代奴役及社會性歧視

Social exclusion and modern-day slavery are still very much alive in Hong Kong.
社會性歧視及現代奴役仍然發生在香港
The year 2015 started with the legal victory of Erwiana Sulistyaningsih over her employer who beat hear up, withheld her salary, denied her rest and food, and treated her as less than human in the months she was under their roof. Even beyond the legal battle, Erwiana’s case showed that a system that makes it possible for a foreign domestic worker (FDW) like her to suffer such abuse and exploitation is significantly flawed.
Erwiana Sulistyaningsih 在為其僱主家中服務期間被虐打，扣薪，拒絕給予食物及休息的個案，在2015年頭的法庭判決獲得勝利。然而，Erwiana的個案展示出讓外藉家務工遭受類同的侵犯可能發生的制度存在嚴重問題。
Unfortunately, instead of initiating long-running changes to the policies that rule the life and livelihood of FDWs in Hong Kong such as the Two-Week Rule and the mandatory live-in employment arrangement, the Hong Kong government has downplayed Erwiana’s experience as an isolated case and does not merit even a genuine review of the condition of FDWs towards reforming policies detrimental to FDW rights.
不幸地，香港政府把Erwiana的經驗描述成個別事件而不對外藉家務工的狀況作出認真檢討改革。對影響著外藉家務工的生活及生命的種種政策作出改善，如兩星期逗留條件及強制在僱主家中住宿的要求等等。
For the Hong Kong government, it is business as usual when it comes to treatment of FDWs – that we remain cheap, insecure and indisposable labor of Hong Kong.
香港政府對外藉家務工的對待仍一如以往，我們仍為置處為香港的廉價，缺乏保障及可棄用的工人。
Despite the very legitimate bases - level of inflation through the years and the economic contribution of FDWs - for a minimum allowable wage of HK$4500, the HK government gave a measly increase of HK$100 to the MAW and an equally paltry HK$31 raise to the monthly food allowance for those who receive such.
外藉家務工提出增薪至4500港元的要求十分合理，因這建基於多年的貨幣眨值及多年的貢獻，香港政府卻只給予100港元工資及31港元饍食津貼的微薄增加。
Meanwhile, as the process to set a rule on working hours in Hong Kong goes on, there is no indication that the Hong Kong authorities are even remotely interested to tackle that inclusion of FDWs to such regulation. Are we set to suffer the same exclusion we experienced when the Statutory Minimum Wage (SMW) was being put in place?
同時，當香港正在討論立法保障標準工時之際，香港政府近乎完全沒有興趣考慮包括外藉家務工在討論之內。就如同香港制定最低工資時一樣，我們又一次遭受著社會性歧視。
The rights of the workers, including FDWs, shall remain at the backseat of priorities for as long as the Hong Kong government subscribes, first and foremost, to the interest of business and capital for profit and not people’s rights, dignity and wellbeing especially of those in the margins. We saw it during times of crisis and even during the so-called period of recovery, relief comes in trickles to many and not even a drop to FDWs.
香港政府始終強調商業及資本利益，而把人民的權利，尊利及生活放於次要位置。如此，工人的權利始終不被重視。處於邊緣位置的社群更加被忽視。我們看到在經濟危機時如是，即使經濟回服時，滴漏給許多人的只是九牛一毛，而外藉家務工則更點滴都沒有。
International human and labor rights standards as UN Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families that inspired the International Migrants’ Day are the benchmarks on rights that the Hong Kong government refuses to acknowledge and follow. Its delusion that its existing policies are in line with human rights standards perpetuates the vulnerability to abuses and exploitation of FDWs as the cse of Erwiana has shown.
引發訂立國際移民日的聯合國『保護所有移徙工人及其家庭成員權利國際公約』實為保障人民及勞工權利的國際標準。而香港政府卻拒絕確認及依循。這在其聲稱乎合人權標準卻又導致外藉家務工處於易被侵犯及剝削狀況的現行種種措施中可見一斑。Erwiana的個案就是一例。
But as what FDWs and the supportive community in HK also showed in the campaign for justice for Erwiana, collective actions will continue for as long as exclusion and modern-day slavery are in place. Justice for all migrant domestic workers can only be achieved if detrimental policies are ended, human rights are upheld and the dignity of migrants are promoted.
然而，在港的外藉家務工及各支援社群在為Erwiana爭取公義的運動中可見，只要排斥及現代奴役仍然存在，連結抗爭的行動亦將持續。只有所有惡法被取消，移民家務工的權利及尊嚴方可得以保障。
As we celebrate International Migrants Day, this is still the fight Asian migrants in Hong Kong and advocates for the rights of FDWs, vow to pursue.
當我們慶祝國際移民日的同時，這仍是在港亞洲移住人士及倡議保障外藉家務工權利者立誓的持續鬥爭。
