人權觀察回應周庭被取消參選人資格

僅因其和平的政治主張而禁止任何人成為候選人,即是剝奪其參加選舉的基本人權,它也是香港實質憲法《基本法》所保障的權利。

數以萬計香港市民上街爭取普選的雨傘運動落幕三年來,北京和香港政府處心積慮縮減港人原本有限的選舉權。北京曾以「解釋」《基本法》的方式干預香港法院審理中的案件,迫使法院取消多名立法會成員的議員資格。今天,在補選開始之際,香港政府再次出手,取消民主派候選人的參選資格。

港府為否定周庭參選資格而提出的法律理由極其牽強,其決定背後的政治動機昭然若揭:它是北京為削弱香港自治權而再次下出的指導棋。”

“To bar anyone from running in elections purely because of their peaceful political stance is a violation of their basic human rights to stand for elections, which is guaranteed under Hong Kong’s functional constitution, the Basic Law.

Three years after the Umbrella Movement, in which tens of thousands of people in Hong Kong stood up for the right to universal suffrage, the Beijing and Hong Kong governments have redoubled efforts to undermine the already limited electoral rights people have in Hong Kong. Beijing had intervened in an ongoing court case in Hong Kong by issuing an ‘interpretation’ of the Basic Law, compelling the court to disqualify scores of pro-democracy legislators. Now, when by-elections open up, the Hong Kong government strike again by disqualifying pro-democratic candidates running for these seats.

The contorted legal arguments advanced by the Hong Kong government in disqualifying Agnes Chow can barely hide the political intentions of its decision: that this is another act in Beijing’s play to chip away Hong Kong’s autonomy.”
