係咪已扣留48小時 與應否批准人身保護令無關

在Kwok Ho Cheung v Commissioner of Police [2019] HKCFI 3052案[1]中,警方懷疑申請人有分參與8月5日的堵路,於12月3日以「公眾地方作出擾亂秩序行為」罪將其拘捕。申請人於12月4日向高等法院申請人身保護令。

高等法院原訟法庭法官林雲浩同日作出決定。林法官認為,香港法例第232章《警隊條例》第52條的規定(即被扣留羈押的人「須在切實可行範圍內盡快帶到裁判官席前」),法律上未必一定強制警方於拘捕後48小時內放人或帶人到裁判官席前。

林法官因此以被捕人當時已被拘禁的時間「只有」18小時、遠遠未滿48小時為由,拒絕人身保護令申請。

恕我直言,此決定並無法理根據。Hooper J在Attorney General V Wong Chi-Ming And Others [1988] 2 HKLR 369一案第377D-E頁中清楚指出,《警隊條例》第52條的目的,是除非被捕人被申請遞解出境,否則警方不可將其扣留超過48小時;但48小時只是上限,所以即使是在被捕後的48小時內,警方仍「須在切實可行範圍內盡快」將其帶到裁判官席前[2]。

But it is unclear whether that has been established as a rule of law in this jurisdiction, though Mr Chan has told me that the general practice is for an arrestee not to be detained for longer than 48 hours in Hong Kong before being brought to a magistrate.

11. The court on an application such as this is concerned with the situation at present. Mr Chan has emphasised that when the application was made shortly after 12 noon today, the applicant had only been detained for about 18 hours and that even now, at the time of the hearing, which commenced at 4pm, we are still far short of 48 hours.'

[2] '... Even within the 48 hour period the prisoner should be brought before the magistrate "as soon as practicable". ...'
