我們就淫褻物品審裁處把刊登於香港獨立媒體網「查禁政治遊戲啟動 呼籲齊貼色情 hyperlink」一文（連圖）暫評為「第二類不雅」深表遺憾。這個判決，再一次證明香港的淫審部門，只懂得機械性地對「性」、「身體」等言論、創作、表達進行評級，完全缺乏對事物的內涵、美／醜、善／惡的判斷力。此外，近年，影視淫審部門針對性小眾（如同志出版）、異見（中大學生報與香港獨立媒體網）的評級，令人擔心這些部門被某些群體騎劫，成為打壓性少眾和異見的工具。
官僚主導的淫審更顯不雅
我們認為「查禁政治遊戲啟動 呼籲齊貼色情 hyperlink」一文（連圖）絕無不雅之處。文章是一篇呼籲公民抗命，以抗議淫審部門以超連結入罪的做法。超連結是一串 html的代碼，把兩個網站連起來的工具，而不是內容本身，不應被視為淫穢物品，而作者提作質疑，並以貼色情 hyperlink的行動抗議，並無不妥。
該文的圖片是透過超連結串流技術引用的，是一張裸體照，先撇除html代碼是否淫穢的論點，從燈光、佈景和模特兒的姿勢，整個構圖是一種人體藝術照的文類(genre)，淫審處以簡單的露點原則去把照片定為不雅，實有辱斯文，亦反映目前淫審制度僵化、官僚。
過去幾年，這種審查的態度，已造成多宗國際笑話（著名藝術作品大衞像於95年被評不雅），去年＜秋天的童話＞被警告、今年中大情色版問卷調查，亦使創作人、文化界、學界與市民憤怒！若這些荒謬、缺乏普通常識 (common sense)的審查繼續下去，一定會造成更大的民怨。
改革淫審 刻不容緩
目前的淫審制度，除了自動送審外，主要是透過處理投訴的方法跟進。近年，有好些具宗教背景的團體──它們對性小眾與身體表達持保守甚至是敵對的態度──組織投訴，透過淫審機制希望把一元的性觀念，變成社會的主流。
正如審計署去年的報告指出，目前淫審處的委員，九成四十歲以上，缺乏性少眾、文化、藝術、不同種族、青年、低下層的代表，以致評審標準一元，被某些群體騎劫。若淫審制度不改，只會變成一個擾民的政府機構，使香港這個多元文化的國際城市，變成一元禁色死城。
我們要求：
１．立即撤銷香港獨立媒體網「查禁政治遊戲啟動 呼籲齊貼色情 hyperlink」一文（Case No: OAGO000147/2007）以及中大學生報情色版（連帶星期日明報）的評級。
２．立即成立具有民意、能反映多元文化、不同年齡層、種族、性傾向組織的委員會，研究如何改革淫審制度，改變機械性的評級，把被審視的物品放回文類、內容、性質等層面去決定。
本聯署將於七月五日(星期四)下午二時連同複審文件交往西灣河，東區法院的淫褻物品審裁處。聯署人請填上姓名，所屬機構／網站和職稱，亦歡迎填上給特區政府的忠告。大家可以於回應欄上聯署，亦可電郵至 [email protected] 聯署，請代為廣傳。此外，我們亦會於七月一日，於獨立媒體（香港）和香港獨立媒體網位於菲林明道的攤位，收集更多簽名。

I work currently at the University of Tokyo, Interfaculty Inititative in Information Studies as a post-doctoral research fellow under a program sponsored by the quasi-governmental Japan Society for the Promotion of Science (JSPS).
I hereby express my support for the petition …..
While recognizing that appropriate measures to regulate content in media are necessary, I share the petition’s concerns, especially that the current system:
- gives inordinate power to individuals and groups with rather extreme views to determine what all people of Hong Kong can read and write. In most systems, the standard is the general public, not its most easily offended groups. A diverse committee can help determine provide a balanced assessment of what the public finds acceptable.
- creates the erroneous impression that the people of Hong Kong are immature and poorly educated in the areas of art, culture, society and critical thinking
- is out of touch with common-sense definitions of indecency and obscenity, exposing Hong Kong to ridicule by the international community and iniviting the resentment and scorn of its citizens
I add to the recommendations of the petition:
1. Improve the definition of terms
- a clear separation of ‘indecent’ and ‘obscene’ with no fines for indecent material
- a definition of ‘obscene’ in line with common sense, which includes looking at the whole work, its effect on its intended audience, its goal and purpose and the social context of its production and consumption. Only works that as a whole lack serious social, artistic, cultural or educational merit should be allowed to be considered ‘obscene.’ Commercial speech should enjoy less protection than art, critique and all kinds of non-profit oriented speech. These are commonly used criteria in many countries.
- the author of the work should be held responsible, not the publisher(s) and distributor(s)
2. Improve the quality of the system and strengthen its support by the public
- no fines for first-time offenders, reduction of fines for non-profit oriented works, increase of fines for profit-oriented works (e.g. spam, ads)
- public hearings about complaint cases with measures to ensure diverse input, not only from the most motivated groups
- improved transparency of the process and possibilities for appeal and redress
- supplementary and soft-touch regulatory measures like media literacy education programs for the public, a mediation system for complaints, e.g. an ombudsman system. Fines should be a last resort and should be reserved for repeat offenders.
- positive measures like annual awards or prizes for works that treat sensitive issues in a daring but artistically and socially valuable way, e.g. promoting understanding and dialogue on issues related to sexuality and gender, education about HIV/AIDS, the socio-economical factors behind the porn industry etc. Good examples can help raise people’s appreciation for such work and reduce demand for low-quality work.
These measures, in addition to those recommended in the petition would greatly help improve acceptance of the regulatory system and better serve the people of Hong Kong.
Finally, I should also note that the site on which the article was published, inmediahk.org is internationally known and recognized as a civil society based media institution of great value to Hong Kong society. The work of In-media has helped promote a very positive image of Hong Kong internationally, precisely because it is controversial and critical.
